Always Talent Agency

Effective Date: September 10, 2026

Last Updated: September 10, 2026

1. Agreement to These Terms

These Terms and Conditions ("Terms") govern your access to and use of alwaystalentagency.com (the "Site") operated by Always Talent Agency ("ATA," "we," "us," or "our").

By accessing the Site, submitting a form, uploading content, or otherwise interacting with us through the Site, you agree to be bound by these Terms and by our Privacy Policy and Cookie Policy, which are incorporated by reference.

If you do not agree to these Terms, do not use the Site.

2. Eligibility

You must be at least 18 years old to use the Site independently or to submit a form on your own behalf.

If you are under 18, you may use the Site only with the involvement of a parent or legal guardian. Any talent submission for a minor must be made and signed by a parent or legal guardian, who accepts these Terms on the minor's behalf and is responsible for the accuracy of the submission.

By using the Site, you represent that you meet these requirements and that you have the legal capacity to enter into these Terms.

3. About Our Services

3.1 What We Do

ATA is a licensed talent agency headquartered in Las Vegas, Nevada, with divisions in Atlanta, Georgia and Miami, Florida. We procure and negotiate employment and engagements for models and actors in film, television, commercials, print, UGC, and events.

Always Talent Management is an affiliated division providing career management services. Agency and management services are distinct, are governed by separate agreements, and may be subject to different regulatory requirements.

3.2 No Fees to Join Our Roster

We do not charge talent a fee to apply, be considered, or be added to our roster. We are compensated by commission on engagements we procure, at the rate set out in a signed representation agreement and within the limits allowed by applicable law.

We do not require talent to purchase photography, training, classes, workshops, coaching, or any other product or service as a condition of representation.

If anyone claiming to represent ATA requests an upfront fee from you, do not pay it. Report it to us at bookings@alwaystalentagency.com.

3.3 The Site Is Informational

The Site is a promotional and informational resource. Nothing on the Site is an offer of representation, an offer of employment, a guarantee of work, or a binding commitment of any kind. Representation, bookings, and engagements are established only through separate written agreements signed by an authorized ATA representative.

3.4 No Guarantee of Results

The entertainment industry is competitive and outcomes are inherently uncertain. We do not guarantee that any talent will be signed, submitted, auditioned, booked, or paid any particular amount, and we make no representation about the volume, frequency, or value of opportunities.

Talent profiles, credits, and blog content reflect past activity and are not a promise of future results.

4. Talent Submissions

4.1 Your Representations

When you submit an application to join our roster, you represent and warrant that:

  • All information you provide is truthful, accurate, current, and complete
  • You are the person depicted in the submitted media, or the parent or legal guardian of that person
  • You own or have obtained all necessary rights to the media you submit, including any photographer or creator permissions
  • Submitting the media does not violate any agreement, release, or third-party right
  • You are legally authorized to work in the United States
  • You are not currently under exclusive representation with another agency in the same market and category, or you have disclosed that representation to us

4.2 License to Use Your Submission

By submitting media and information to us, you grant ATA a non-exclusive, royalty-free, worldwide license to reproduce, display, adapt, and distribute your submission for the purpose of evaluating your application and, if we offer representation, marketing you to clients, casting directors, and casting platforms.

This license exists to let us do our job as your agency. It does not transfer ownership of your media, does not permit use unrelated to your representation, and does not authorize licensing your likeness for advertising ATA's own products or services without your separate consent.

We do not license, sell, or provide talent media for use in training generative artificial intelligence systems.

This license ends when your submission is declined and your media is removed, or when representation ends and you request removal — except for materials already delivered to clients or published by third parties, which are outside our control.

4.3 No Obligation and No Confidentiality

We receive a high volume of submissions. We are under no obligation to review, respond to, retain, or return any submission, and we may decline any application for any lawful reason or no reason.

Do not send us confidential or proprietary material. Unsolicited submissions are not treated as confidential and create no confidential relationship between us.

4.4 Ideas and Concepts

If you send us creative ideas, concepts, treatments, or project pitches, you agree that we may use, develop, or disregard them without obligation, compensation, or credit. The entertainment industry generates similar ideas independently, and we do not accept liability for material that resembles something you sent us.

5. Booking Inquiries and Client Engagements

5.1 Inquiries Are Not Bookings

Submitting a booking inquiry through the Site starts a conversation. It does not reserve talent, confirm availability, create a hold, or bind either party.

A booking exists only when confirmed in writing through a deal memo, booking confirmation, or contract signed by an authorized ATA representative.

5.2 Client Obligations

If you engage ATA to book talent, you agree that:

  • Usage rights, territory, term, exclusivity, and compensation are defined by the applicable deal memo, and any use beyond those terms requires additional negotiation and payment
  • Talent images, footage, and likeness may be used only within the licensed scope
  • You will maintain a safe, lawful, and professional working environment, including compliance with applicable rules for minors on set
  • You will pay invoices according to agreed terms, and late payment may accrue interest as permitted by law
  • Cancellation and rescheduling are subject to the fees stated in the applicable deal memo

5.3 Accuracy of Your Inquiry

You represent that the information in your inquiry is accurate and that you have the authority to engage talent on behalf of the company or production you identify.

6. Acceptable Use

You agree not to:

  • Use the Site for any unlawful purpose or in violation of these Terms
  • Submit false, misleading, fraudulent, or impersonating information
  • Upload content that is defamatory, obscene, harassing, infringing, or otherwise objectionable
  • Upload malware, viruses, or any code designed to disrupt or damage the Site
  • Attempt to gain unauthorized access to the Site, our systems, or our accounts
  • Use automated tools — including scrapers, crawlers, bots, or harvesters — to access, copy, monitor, or extract Site content or talent data, except for search engine indexing that respects our robots.txt
  • Collect, compile, or store talent images, contact details, or profile data for any purpose other than a legitimate casting or booking inquiry made through the Site
  • Use Site content, including talent media, to train, fine-tune, or develop artificial intelligence or machine learning systems
  • Contact talent directly to circumvent ATA representation
  • Reproduce, republish, mirror, or resell Site content without our written permission
  • Interfere with the Site's operation or place unreasonable load on our infrastructure
  • Misrepresent yourself as affiliated with, endorsed by, or acting on behalf of ATA

We may investigate suspected violations and take any action we deem appropriate, including removing content, suspending access, and reporting to law enforcement.

7. Intellectual Property

7.1 Our Content

The Site and its contents — including text, design, layout, graphics, logos, the Always Talent Agency and Always Talent Management names and marks, code, and compilation of talent profiles — are owned by ATA or our licensors and protected by United States and international intellectual property laws.

We grant you a limited, revocable, non-exclusive, non-transferable license to access and view the Site for your personal or internal business use in connection with legitimate casting, booking, or employment purposes. All other rights are reserved.

7.2 Talent Media

Photographs, video, and other media appearing on the Site are owned by the photographers, creators, talent, or licensors who produced them and are displayed under license. Nothing on the Site grants you any right to use talent images or likeness. Unauthorized use of a person's name, image, or likeness may violate right-of-publicity, copyright, and other laws.

7.3 Trademarks

Third-party names and marks appearing on the Site are the property of their respective owners and are used for identification only. Their appearance does not imply endorsement or affiliation.

7.4 Copyright Complaints

If you believe content on the Site infringes your copyright, send a notice under the Digital Millennium Copyright Act to bookings@alwaystalentagency.com including: identification of the work, identification of the infringing material and its location, your contact information, a statement of good-faith belief that the use is unauthorized, a statement that your notice is accurate and that you are authorized to act, and your physical or electronic signature.

8. Favorites and Site Features

The Favorites feature stores selected talent profiles in your browser's local storage on your device. This list is not an account, is not backed up by us, does not sync across devices, and may be lost if you clear your browser data or change devices. Saving talent to Favorites does not reserve or hold that talent.

We may add, modify, or discontinue Site features at any time without notice.

9. Careers and Employment Applications

Job postings on the Site are informational and may be filled, modified, or withdrawn at any time. Submitting an application does not create an employment relationship or any obligation to interview or hire. Any employment offer will be made in writing and is subject to its own terms. Unless a written agreement states otherwise, employment with ATA is at-will.

10. Blog and Educational Content

Articles on the Site are general industry commentary published for informational purposes. They are not legal, financial, tax, career, or professional advice, and should not be relied on as a substitute for advice from a qualified professional who knows your situation. Industry practices change, and we do not warrant that content remains current.

11. Third-Party Links and Services

The Site links to and embeds third-party content, including social media platforms and casting platforms. We do not control these services, do not endorse their content, and are not responsible for their availability, accuracy, practices, or policies. Your use of third-party services is governed by their terms.

12. Disclaimers

THE SITE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that the Site will be uninterrupted, timely, secure, or error-free, that defects will be corrected, that the Site is free of harmful components, or that content — including talent availability, credits, and attributes — is accurate, complete, or current.

Some jurisdictions do not allow the exclusion of certain warranties, so some of these exclusions may not apply to you.

13. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, ATA AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST OPPORTUNITIES, LOST DATA, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE, WHETHER BASED IN CONTRACT, TORT, STRICT LIABILITY, OR ANY OTHER THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SITE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID ATA IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).

These limitations apply to the Site and these Terms. They do not limit obligations set out in a separate signed representation agreement, deal memo, or booking contract, which are governed by their own terms.

Some jurisdictions do not allow certain limitations of liability, so some of these limitations may not apply to you.

14. Indemnification

You agree to indemnify, defend, and hold harmless ATA and its officers, directors, employees, agents, and affiliates from any claims, damages, losses, liabilities, and expenses — including reasonable attorneys' fees — arising out of or relating to: your use of the Site; your violation of these Terms; your violation of any law or third-party right; content you submit, including any claim that it infringes intellectual property or right-of-publicity; or any misrepresentation you make to us.

15. Governing Law and Disputes

15.1 Governing Law

These Terms are governed by the laws of the State of Nevada, without regard to its conflict-of-laws principles.

15.2 Informal Resolution

Before filing a claim, you agree to contact us at bookings@alwaystalentagency.com and attempt to resolve the dispute informally for at least thirty (30) days. Most disputes can be resolved this way.

15.3 Venue

Any dispute not resolved informally will be brought exclusively in the state or federal courts located in Clark County, Nevada. You consent to the personal jurisdiction of those courts and waive any objection based on venue or inconvenient forum.

15.4 No Class Actions

To the extent permitted by law, disputes will be resolved on an individual basis. You agree not to bring or participate in a class, collective, or representative action against ATA.

15.5 Time Limit

Any claim arising out of or relating to these Terms or the Site must be filed within one (1) year after the claim arose, or it is permanently barred, except where a longer period is required by law.

16. Termination

We may suspend or terminate your access to the Site at any time, with or without notice, for any reason, including violation of these Terms.

Sections concerning submissions, intellectual property, acceptable use, disclaimers, limitation of liability, indemnification, and governing law survive termination.

17. General Provisions

Entire agreement. These Terms, together with the Privacy Policy and Cookie Policy, are the entire agreement between you and ATA regarding the Site. They do not supersede any separate signed representation agreement, deal memo, or booking contract, which control as to their subject matter.

Severability. If any provision is found unenforceable, it will be limited or severed to the minimum extent necessary, and the remaining provisions stay in effect.

No waiver. Our failure to enforce any provision is not a waiver of our right to enforce it later.

Assignment. You may not assign these Terms without our written consent. We may assign them in connection with a merger, acquisition, or sale of assets.

No third-party beneficiaries. These Terms create no rights in any third party.

Force majeure. We are not liable for delays or failures caused by events beyond our reasonable control, including natural disasters, labor disputes, industry strikes, outages, or government action.

Headings. Section headings are for convenience only and do not affect interpretation.

18. Changes to These Terms

We may update these Terms at any time. Updates take effect when posted, and we will revise the "Last Updated" date above. Material changes will be accompanied by additional notice on the Site. Your continued use after changes take effect constitutes acceptance. If you do not agree to the revised Terms, stop using the Site.
